§ 50-5. R-1 Residential.

  • (a)

    Description and purpose. The R-1 residential zone is the most restrictive of residential zones, composed chiefly of individual homes on lots, and specifically excludes mobile homes and HUD-code manufactured homes.

    (b)

    Permitted use. Permitted uses in the R-1 residential zone include the following:

    (1)

    One-family dwellings, including home occupations.

    a.

    The home occupation use does not exceed more than 50 percent of the gross floor area of the residence.

    b.

    It is the bona fide residence of the practitioner and does not depend on the employment of a person who does not reside in the residence.

    c.

    An entrance is not specifically dedicated for the home occupation.

    d.

    The occupation shall be conducted entirely within the residence.

    e.

    The residential character and appearance of the lot and dwelling shall be maintained.

    f.

    The activity shall not create customer related or deliver related vehicular traffic in excess of three vehicles in a 24-hour day in the residential neighborhood.

    g.

    The activity shall not produce any external noise, vibrations, smoke, dust, odor, glare, fumes, electrical interference, or waste runoff outside the dwelling unit or on the property surrounding the dwelling unit.

    h.

    The activity shall not be advertised by any signs on the premises, nor shall the street address of the resident be advertised through signs, billboards, television, radio, newspaper, bulletin boards, coupon books, internet, flyers or public mail outs.

    i.

    It does not require or use outdoor storage or the display of materials, merchandise, goods or equipment.

    j.

    It is conducted so that it does not create parking or traffic congestion or otherwise unreasonably interfere with the peace and enjoyment of surrounding homes as places of residence.

    k.

    The occupation shall be operated in accordance with all applicable laws and, if a state permit is required, such permit shall be obtained prior to beginning of operation.

    l.

    Customary home occupations shall not include any form of merchandising activity that brings customers to the home for the purpose of transacting any business.

    (2)

    Parks.

    (3)

    Public buildings.

    (4)

    Religious institutions.

    (c)

    Minimum lot area. Minimum lot area is 6,000 square feet or, for a registered platted subdivision lot existing at the time of passage of the ordinance from which this chapter is derived, the area of the lot.

    (d)

    Permitted accessory uses. Permitted accessory uses in the R-1 residential zone are as follows:

    (1)

    Garden houses, tool houses and play houses, so long as the same are in compliance with FEMA regulations.

    (2)

    Temporary signs, no larger than four square feet. Political signs limited to 30 days prior to the date of the election. All temporary signs must be removed no later than 15 days after the sale, event or election is concluded.

    (e)

    Setback minimum. There shall be a setback minimum of 25 feet from the property line facing streets, alley easements, and private roads, minimum of five feet from the property line on the sides a minimum of ten feet from the property line on the back roof eaves not to exceed 18 inches.

    (f)

    Floor space. Floor space is a minimum of 800 square feet of living area.

    (g)

    Parking. Parking is a minimum of one parking space per 300 square feet of living area.
