§ 38-41. Definitions.

  • As used in this article, the following words and phrases shall have the following meanings:

    Commercial solid waste means any garbage that is not capable of being disposed of in a 50 gallon trash bag.

    Household waste does not include building materials, remodeling debris, roofing material, carpet, nails, trim, furniture, appliances, or any hazardous materials.

    Person means any person, association, corporation, partnership or other legal entity and includes but is not limited to the owner of the legal or equitable title of real property as well as any lessee, tenant or occupant of any real property.

    Private owned collection services means any person who collects, conveys and disposes of solid waste and collects the fees for such services.

    Public trash receptacles means those receptacles located on the beach and in other public areas.

    Solid waste means any garbage, refuse, sludge, and any discarded material, including solid, liquid, semi-solid, or contained gaseous material resulting from municipal, commercial, residential and community activities.
