§ 26-2. Intoxicating substances.

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Intoxicating substance means any substance other than alcohol capable of producing in any individual a degree of intoxication which may endanger such individual or another and which would justify an arrest under V.T.C.A., Penal Code § 49.02, if such individual were to appear in a public place under the influence of such substance to such degree.

    (b)

    Possession of intoxicating substances prohibited. It shall be unlawful for any person to possess an intoxicating substance within the corporate limits of the village.

    (c)

    Exception. It is an exception to the application of subsection (b) of this section if the intoxicating substance is one the possession of which by such person is expressly authorized or permitted by the law of the state.
